1. Acceptance of Terms

By accessing or using Togoal ("the Service"), operated at togoal.co, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and Togoal. We reserve the right to update these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service.

2. Account Terms

  • You must be at least 16 years old to create an account
  • You must provide a valid email address and accurate information
  • You are responsible for maintaining the security of your account and password
  • You are responsible for all activities that occur under your account
  • You may not use another person's account without their permission
  • One person or entity may maintain only one free account
  • You must notify us immediately of any unauthorized use of your account

3. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Post, distribute, or link to content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Distribute malware, viruses, or any other harmful software
  • Engage in phishing, scams, or fraudulent activities
  • Impersonate any person or entity, or falsely claim affiliation with any person or entity
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to other users' accounts or data
  • Manipulate click counts, analytics data, or engage in click fraud
  • Use automated tools (bots, scrapers) to access the Service without permission
  • Upload content that infringes on intellectual property rights of others
  • Promote violence, hate speech, discrimination, or illegal activities
  • Sell, resell, or exploit the Service for unauthorized commercial purposes

4. User Content

You retain all ownership rights to the content you create and upload to the Service ("User Content"), including links, profile information, images, and media files.

By posting User Content, you grant Togoal a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and providing the Service.

You represent that you own or have the necessary rights to all User Content you post, and that your content does not violate any third party's intellectual property or privacy rights.

5. Intellectual Property

The Service, including its original content, features, and functionality (excluding User Content), is owned by Togoal and protected by international copyright, trademark, and other intellectual property laws.

"Togoal" and the Togoal logo are trademarks of Togoal. You may not use our trademarks without prior written consent.

6. Paid Plans and Billing

  • Paid plans are billed on a monthly or annual basis as specified at the time of purchase
  • Payments are non-refundable except where required by law
  • You may cancel your subscription at any time; access to paid features will continue until the end of the billing period
  • We reserve the right to change pricing with 30 days advance notice
  • Failure to pay may result in downgrading your account to the free plan

7. Privacy and Data Protection

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

If you use email collection features (subscriber forms), you act as a data controller for your subscribers' data and are responsible for compliance with applicable data protection laws, including obtaining proper consent.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may temporarily suspend the Service for maintenance, updates, or due to circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice where possible.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOGOAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be error-free, secure, or available at all times, or that any defects will be corrected.

11. Indemnification

You agree to indemnify and hold harmless Togoal and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.

12. Account Termination

  • You may delete your account at any time through the account settings page
  • We may suspend or terminate your account if you violate these Terms
  • Upon termination, your right to use the Service ceases immediately
  • We may retain certain data as required by law or for legitimate business purposes
  • Account data will be permanently deleted within 30 days of account deletion

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Togoal operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
